1. Introduction

Welcome to Peaksy. These Terms of Service ("Terms") govern your use of the Peaksy platform, including our website and mobile application (collectively, the "Platform").

Peaksy is operated by Symph, Inc., a company registered in the Philippines. References to "Peaksy," "we," "us," or "our" in these Terms refer to Symph, Inc. operating as Peaksy.

By creating an account or using Peaksy, you agree to these Terms. If you do not agree, do not use the Platform.

Peaksy is a marketplace. We connect hikers with hiking organizers. We do not organize, operate, or lead hiking events ourselves.

2. Definitions

  • "Peaksy," "we," "us," "our" — Symph, Inc., the company operating this Platform
  • "User," "you," "your" — Any person using the Platform
  • "Hiker" — A user who books events through the Platform
  • "Organizer" — A user who lists and operates hiking events
  • "Event" — A hiking trip, trek, or outdoor activity listed on the Platform
  • "Service Fee" — The fee Peaksy charges hikers for using the Platform

3. Account Terms

3.1 Eligibility

You must be at least 18 years old to create an account. If you are under 18, a parent or guardian must create an account on your behalf and accept responsibility for your use.

3.2 Account Creation

  • Provide accurate, complete information
  • Use a valid email address and phone number
  • Create a secure password
  • One account per person

3.3 Account Security

You are responsible for maintaining the security of your account. Do not share your login credentials. Notify us immediately if you suspect unauthorized access.

3.4 Account Termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms.

4. How Peaksy Works

4.1 We Are a Facilitator

Peaksy is a marketplace that connects hikers with organizers. We are not the organizer, operator, or guide of any event listed on the Platform.

4.2 Organizers Are Independent

Organizers are independent individuals or businesses. They are not employees, agents, or partners of Peaksy. They set their own prices, schedules, routes, and policies.

4.3 No Guarantee

We do not guarantee the quality, safety, or occurrence of any event. We do not verify every claim made by organizers. Use your judgment when booking.

5. Booking and Payment

5.1 How Booking Works

  1. Browse events and select one you want to join
  2. Review event details, including the organizer's cancellation policy
  3. Pay the reservation fee (typically 50% of the event price, set by organizer)
  4. Your remaining balance is automatically charged 3 days before the event
  5. You may pay the remaining balance early anytime via "Pay Now"

5.2 Service Fee

Peaksy charges a 15% service fee on top of the organizer's event price. This fee covers:

  • Payment processing (5%)
  • Platform operation and support (10%)

The service fee is shown separately at checkout:

5.3 Payment Methods

We accept credit cards, debit cards, and other payment methods as available through our payment partners.

5.4 Payment Failure

If your remaining balance payment fails 3 days before the event:

  • You have a 12-hour grace period to update your payment method
  • If payment still fails, your booking is cancelled
  • Your reservation fee is non-refundable in this case

5.5 Organizer Payouts

Organizers receive their payout within 1 business day after each payment is collected.

6. Cancellation and Refunds

Our full Cancellation and Refund Policy is available at peaksy.app/cancellation. Key points:

6.1 Hiker Cancellation

  • Before cutoff: Full refund (event price + service fee)
  • After cutoff: No refund

The cancellation cutoff is set by each organizer (typically 7 days before the event, up to 60 days for major climbs). Check the event page for the specific cutoff.

6.2 Organizer Cancellation

If an organizer cancels an event, you receive a full refund. Peaksy absorbs the service fee — you are never penalized for an organizer cancellation.

6.3 No-Show

If you do not attend an event without cancelling, your reservation fee is forfeited.

6.4 Goodwill Refunds

For genuine emergencies after the cutoff (medical emergency, death in family, natural disaster), contact support with documentation. Approved cases receive full refunds.

7. Assumption of Risk

7.1 Hiking Is Dangerous

Hiking and outdoor activities involve inherent risks including but not limited to:

  • Physical injury (falls, sprains, fractures)
  • Environmental hazards (weather, terrain, wildlife, altitude)
  • Exhaustion, dehydration, heat stroke, hypothermia
  • Getting lost
  • Medical emergencies in remote locations

7.2 Your Responsibility

By booking an event, you acknowledge these risks and accept responsibility for:

  • Assessing whether you are physically fit for the activity
  • Bringing appropriate gear and supplies
  • Following safety instructions from guides
  • Making your own decisions about whether to proceed in challenging conditions

7.3 Organizer Waivers

Many organizers require you to sign a separate liability waiver before participating. This is between you and the organizer. Signing or not signing their waiver does not affect these Terms.

7.4 No Guarantee of Safety

Neither Peaksy nor organizers can guarantee your safety. Outdoor activities carry risks that cannot be eliminated regardless of precautions taken.

8. Limitation of Liability

8.1 Peaksy Is Not Liable For:

  • Organizer actions, decisions, or negligence
  • Event cancellations or changes
  • Weather conditions
  • Personal injury, illness, or death during events
  • Loss, theft, or damage to personal property
  • Accuracy of event descriptions
  • Actions of other participants

8.2 Maximum Liability

To the fullest extent permitted by law, Peaksy's total liability to you for any claims arising from your use of the Platform is limited to the total service fees you paid to Peaksy in the 12 months before the claim.

8.3 Disclaimer

The Platform is provided "as is" without warranties of any kind. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

9. User Conduct

9.1 You Agree Not To:

  • Make fraudulent bookings
  • Provide false information
  • Harass, threaten, or abuse organizers or other users
  • Manipulate reviews or ratings
  • Circumvent the Platform to avoid fees
  • Use the Platform for any illegal purpose
  • Violate these Terms or applicable laws

9.2 Consequences

Violations may result in:

  • Warning
  • Booking cancellation
  • Account suspension
  • Permanent ban
  • Legal action

10. Reviews

10.1 Posting Reviews

After attending an event, you may post a review. Reviews must be:

  • Based on your actual experience
  • Honest and fair
  • Free from personal attacks
  • Compliant with our Community Guidelines

10.2 Content License

By posting reviews or other content, you grant Peaksy a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content on the Platform and for marketing purposes.

11. Intellectual Property

11.1 Peaksy Owns

The Platform, including its design, features, branding, and content (excluding user-generated content), is owned by Peaksy and protected by intellectual property laws.

11.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes in accordance with these Terms.

12. Dispute Resolution

12.1 Contact Us First

If you have a dispute, contact support@peaksy.app. We will work in good faith to resolve it.

12.2 Mediation

If we cannot resolve the dispute directly, both parties agree to attempt mediation before pursuing legal action.

12.3 Governing Law

These Terms are governed by the laws of the Republic of the Philippines.

12.4 Jurisdiction

Any legal proceedings shall be brought in the courts of Cebu City, Philippines.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Platform. Your continued use after changes take effect constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Cancellation Policy, constitute the entire agreement between you and Peaksy regarding your use of the Platform.
